1. About these terms
These terms form the contract between you and CB Merch when we accept your order. They do not affect rights that cannot legally be excluded.
2. Business identity and contact
CB Merch can be contacted at hello@cbmerch.co.uk. Our geographical trading address must be supplied on the live website before orders are accepted.
3. Products
We take reasonable care to describe and display products accurately. Colours may vary according to screens and manufacturing processes. Product dimensions may have reasonable tolerances.
4. Orders and contract formation
Submitting an order is an offer to buy. An automated acknowledgement does not by itself mean the order has been accepted. The contract is formed when payment is confirmed and we issue an order confirmation, subject to stock availability and fraud checks.
5. Prices and payment
Prices and applicable delivery charges are shown before payment. Payment is processed securely by Stripe. We do not store full card details. If a pricing error is obvious, we may cancel the order and refund any payment rather than supply at the incorrect price.
6. Availability and cancellation by us
All orders are subject to availability. If an item cannot be supplied, we will contact you and refund the affected amount. We may refuse or cancel an order where reasonably necessary, including suspected fraud, payment failure, an obvious pricing error or inability to deliver.
7. Delivery
Dispatch and delivery are governed by our Delivery Policy. Unless otherwise agreed, goods will be delivered without undue delay and within the period required by law.
8. Cancellation, returns and refunds
Your rights and our procedure are set out in the Returns & Refunds Policy, which forms part of these terms.
9. Personalised goods
You are responsible for checking personalisation details before ordering. Personalised goods cannot normally be cancelled for change of mind once production has begun, but statutory rights for faulty, damaged or misdescribed goods remain.
10. Intellectual property
Website content, branding, artwork and original designs remain owned by CB Merch or the relevant rights holder. Buying a product does not transfer intellectual property rights or grant permission to reproduce, resell or commercially exploit a design.
11. Liability
We do not exclude liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights. Subject to law, we are not responsible for losses that were not reasonably foreseeable or for business losses arising from a consumer purchase.
12. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to minimise the effect and keep affected customers informed.
13. Governing law
These terms are governed by the law of England and Wales. Consumers may bring proceedings in the courts applicable to their place of residence where the law permits.
14. Changes
The terms applying to an order are those available when the order is placed. We may update these terms for future orders.
